Supreme Court cannot amend the Constitution in a case against Mahama, according to Amaliba

John Dramani Mahama’s plan to run for president once again in 2024 is being challenged in court, according to National Democratic Congress (NDC) Director of Legal Affairs Abraham Amaliba, however this complaint lacks any foundation.

When Johnnie Hughes on the Sunrise show on 3FM on Wednesday, June 14 asked Mr. Amaliba how the NDC would handle the situation if the Supreme Court granted the reliefs that the suit’s plaintiff, Managing Editor of the Searchlight Ken Kuranchie, was seeking, Mr. Amaliba responded, “The Supreme Court doesn’t write the Constitution… The Supreme Court cannot write the Constitution and cannot insert words and letters in the Constitution.Where does the Constitution specify that a person who serves a single term and does not return to serve more terms consecutively is prohibited from doing so again?

A declaration that according to a genuine and appropriate interpretation of Article 66 (1) of the 1992 Constitution, the length of a presidential term in Ghana is four years is one of the reliefs sought by Mr. Kuranchie.

A statement stating, according to a genuine and accurate reading of Sections 66(1) and (2) of the 1992 Constitution, the incumbent president must be the one running for reelection.

“A directive to [John Mahama] to fully disclose to Parliament the conditions of his interactions with Parliament as a political party’s flagbearer.”

Mr. Mahama was most recently chosen to represent the NDC in the general elections in 2024.

He won 297,603 (98.9%) of the legitimate votes cast during the NDC primaries on Saturday, May 13, 2023, becoming the party’s presidential candidate for the fourth time.
